- Speeding above certain levels (20-30 mph over the limit) while driving under the influence
- A blood alcohol or breath alcohol test of .20% or greater
- Refusing to submit to a chemical test of blood, breath, or urine
- The person arrested is under the age of 21 at the time of offense
- Prior convictions of dui, dwi, oui, owi, or other related drunk driving offense
- A child is also in the car at the time of offense
In many states, if someone is injured, even if the passenger in that car is injured, the case may be considered a felony DUI arrest. And if there is a death, the driver can be charged with vehicular manslaughter or murder. Enhancement may be possible if a child is in the car.
