Breath Alcohol Ignition Interlock Device (BAIID)

What is an Ignition Interlock Device?

An ignition interlock device is similar to a breathalyzer device. An ignition interlock device, however, is connected to a vehicle dashboard or other location inside a vehicle and requires that a driver breathe into the device prior to starting it. If the ignition interlock device detects the blood alcohol concentration of the driver to be above the programmed limit in the device, then the engine of the vehicle will not start.

Ignition Interlock Devices in Illinois

A first-time DUI offender in Illinois is eligible to have a Breath Alcohol Ignition Interlock Device (BAIID) installed in his or her vehicle. This device will prevent the vehicle from starting until the driver passes a breath test. The device is also equipped with a camera to take an image of the driver as the test is performed. Any costs associated with the issuance, installation and monitoring of the BAIID are the responsibility of the offender.

The installation of the BAIID is required of all first-time offenders who are not able to successfully challenge the breath test suspension and want to obtain driving relief during the period of statutory summary suspension, provided that the driver is eligible. A driver must obtain a Monitoring Device Driving Permit (MDDP) in order to be eligible for driving relief.  Installation of the BAIID will then be authorized by the Secretary of State’s office, and it will alert the office of any attempts to drive under the influence or of any tampering with the device. If a DUI offender is found driving any vehicle that is not equipped with a BAIID, he or she will be guilty of a Class 4 felony.

A BAIID is also a requirement for repeat DUI offenders as a condition of receiving a Restricted Driving Permit (RDP). An individual with two or three DUI convictions must install a BAIID on all vehicles registered in his or her name for 12 consecutive months. This is a prerequisite for a full reinstatement of driving privileges.
